2. Applicability
These general terms and conditions apply to every offer made by Mistive Boutique and to every distance contract concluded between Mistive Boutique and the consumer.
Before a distance contract is concluded, the text of these general terms and conditions is made available to the consumer.
If one or more provisions of these terms and conditions are wholly or partially void or annulled, the remaining provisions will continue to apply in full.
3. The Offer
The offer contains a complete and accurate description of the products offered.
Obvious mistakes or errors in the offer do not bind Mistive Boutique.
Each offer contains sufficient information so that it is clear to the consumer what rights and obligations are involved when accepting the offer.
4. The Agreement
The agreement is concluded at the moment the consumer accepts the offer and meets the stated conditions.
Mistive Boutique will immediately confirm receipt of the acceptance of the offer by email.
Mistive Boutique reserves the right to refuse an order or attach additional conditions to its execution, provided this is within reasonable limits.
5. Right of Withdrawal
The consumer has the right to cancel the agreement within 30 days after receiving the product, without stating a reason.
During the cooling-off period, the consumer shall handle the product and its packaging with care.
If the consumer makes use of the right of withdrawal, they shall return the product undamaged and—if reasonably possible—in its original condition and packaging, in accordance with the instructions provided by Mistive Boutique.
Return shipping costs are the responsibility of the consumer, unless otherwise agreed.
6. Prices
The prices of the products include VAT and exclude shipping costs, unless stated otherwise.
All prices are subject to obvious errors.
Mistive Boutique reserves the right to change prices; however, the price applicable at the time of ordering is binding.
7. Payment
Payment must be made via the available payment methods on the website of Mistive Boutique.
The consumer is obliged to immediately report any inaccuracies in the provided payment details to Mistive Boutique.
8. Delivery and Execution
Mistive Boutique will exercise the utmost care when receiving and executing orders.
The delivery address is the address the consumer has provided to Mistive Boutique.
Mistive Boutique aims to dispatch orders within the indicated delivery time. Any delays will be communicated to the consumer in a timely manner.
The risk of damage and/or loss of products rests with Mistive Boutique until the moment of delivery to the consumer.
9. Warranty and Conformity
Mistive Boutique guarantees that the products comply with the agreement, the specifications stated in the offer, and reasonable standards of quality.
If a product shows a defect, the consumer must report this as soon as possible, and no later than 14 days after discovery, in writing to Mistive Boutique.
The warranty does not apply if the defect has arisen due to improper or inappropriate use by the consumer.
10. Liability
Mistive Boutique is not liable for damage caused by incorrect or improper use of the delivered products.
The liability of Mistive Boutique is limited to the purchase price of the relevant product.
11. Force Majeure
Mistive Boutique is not obliged to fulfil any obligation if prevented from doing so due to force majeure.
Force majeure includes any circumstance beyond the control of Mistive Boutique that temporarily or permanently prevents fulfilment.
12. Complaints Procedure
Complaints regarding the execution of the agreement must be submitted to Mistive Boutique in a timely manner, fully and clearly described.
Mistive Boutique will respond to complaints within 14 days after receipt.
If a complaint requires more processing time, the consumer will be notified along with an indication of when a final response can be expected.
13. Disputes
All agreements between Mistive Boutique and the consumer to which these general terms and conditions apply are governed exclusively by Dutch law.
Disputes may be submitted to the competent court in the district in which Mistive Boutique is located.
14. Intellectual Property
All intellectual property rights regarding the content of the website, products, texts, images, and other materials belong to Mistive Boutique or its licensors.
Without written permission from Mistive Boutique, it is not permitted to copy, distribute, or otherwise use this material.
